Legal Brokerage Company «Yvira Co» — is a Company which is a part of the Group of Companies «Ukraine Zahid». The Company was founded in 2002 as a form of Private Enterprise.

Permanent Court

On 1.02.2006 the Permanent Court of Arbitration of the Universal Commodities Exchange «Ukraine-Zahid» was found by the Universal Commodities Exchange with the help of the leading legal companies of the Western Regions of Ukraine. This Court was registered in authorities of the ministry of Justice in March 2006.

The idea of Court of Arbitration forming was the idea to unite the interests of natural and legal persons in order to make conditions for solving of disputes with realization of alternative legal proceeding system and its popularization.

Court of Arbitration of the Universal Commodities Exchange «Ukraine-Zahid» is a real member of the Arbitration Chamber of Ukraine (Decision № 12 of the Presidium of Chamber of Commerce of Ukraine from 22.02.2008), and it is registered as one of the Ukrainian Arbitration Courts with permanent activity.

The Court of Arbitration is an independent and private Permanent Court of Arbitration, which performs its activity according to the Law of Ukraine «About Courts of Arbitration», under the Regulations of the Permanent Court of Arbitration of the Universal Commodities Exchange «Ukraine-Zahid».

The main task of the Court of Arbitration activity is the protection of material and non-material rights, which are under the law protection of interests of the natural and legal persons – parts of the arbitrational investigation. The main conception of the activity of the Court of Arbitration is the settlement of problems on the basis of trust of parties to take a matter to the Court of Arbitration for adjustment of disputes by peace agreement or by adjudication of the fair and clever decision.

The Court of Arbitration of the Universal Commodities Exchange “Ukraine-Zahid” is a court with permanent activity, which has not more than twenty arbitrator and investigates any disputes which appear between legal and natural persons concerning civil and economic legal relationships, except disputes which according to the current legislation of Ukraine can not be judicable in Court of Arbitration. For example:

  • cases and disputes concerning invalidation of legal acts;
  • cases and disputes concerning concluding, changing, termination and execution of economic agreements connected with satisfaction of the state requirements;
  • cases connected with state secrets;
  • cases and disputes concerning legal family relationships, except cases and disputes which occur because of agreement of marriage (treaty)
  • cases concerning resumption of payment ability of debtor or recognition of a person as a bankrupt.
  • cases in which one of the parties is a state authority body, local government body, its representative or official or other person who performs authoritative management functions on the basis of the current legislation, including delegated powers; state body or organization, government enterprise;
  • cases and disputes concerning real estate including plot of land;
  • cases concerning fact finding which have judicial importance;
  • cases and disputes concerning personnel management;
  • cases which occur from corporative relations in disputes between economic enterprise and its member (founder, shareholder) including member, who discontinued his membership and also between members (founders, shareholders) of the economic enterprises, connected with organization, activity, management and termination of activity of these enterprises.
  • other cases which according to the law are the subjects for consideration only in Courts of general jurisdiction or in Constitutional Court of Ukraine;
  • cases in which one of the parties is a non resident of Ukraine;
  • cases under decisions of which the execution of Court of Arbitration decisions will be executed by state authority bodies, local government bodies or their representatives, officials or other person who performs authoritative management functions on the basis of the current legislation, including delegated powers.

The staff of arbitrators consists mostly of barristers, directors and managers of enterprises, other specialists, which have the sufficient level of proficiency and established a reputation as leaders of their sphere in definite regions.

From the moment of the establishment, the Court of Arbitration examined more than 250 cases of different character (material and non-material character) – about recognition the rights of property, recognition the agreements as legible between legal and natural persons, debt collection etc. All cases had different matters and were taken into consideration on principles of completeness, fullness and objectivity. The Court of Arbitration delivered judgments, the most parts of which were directed for executive instrument receipt to state (competent) courts.

The Court of Arbitration consists of the Chief of the Court of Arbitration, arbitrators, and also Secretariat, which is formed from Secretary of the Court of Arbitration and other officials of Secretariat, the number and membership of which are determined by the Chief of the Court.

At the moment the Court of Arbitration is managed by Prokopchuk, Oleh Mykhaylovych, who is barrister, Director of Commodities Exchange «Ukraine Zahid» and the current member of the Arbitration Chamber of Ukraine.

The mechanisms of the alternative jurisdiction of Ukraine can be used also by representative offices of other companies, which perform the economic activity on the territory of Ukraine, and also companies, the founders of which are non-residents of Ukraine, which are registered in Ukraine.
